These terms and conditions outline the rules and regulations for the use of NYT Farm's Website, located at nytfarm.com.

By accessing this website we assume you accept these terms and conditions. Do not continue to use NYT Farm if you do not agree to take all of the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: "Client", "You" and "Your" refers to you, the person logging onto this website and compliant to the Company's terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us", refers to NYT Farm. "Party" or "Parties", refers to both the Client and NYT Farm. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of NYT Farm's assistance to the Client in the most appropriate manner for the express purpose of meeting the Client's needs in respect of provision of the Company's stated services, in accordance with and subject to, prevailing law of the state of Texas. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to the same.

LOTUG Entertainment LLC, DBA NYT Farm (hereafter referred to as: NYT Farm)

NYT Farm is a "Grow to Order" Microgreen Farm. Once orders have been placed AND paid for, NYT Farm will start the growing the microgreen(s) for the agreed upon delivery / pick-up date. Customers have the option to receive their order via pick-up or delivery. Please be advised: Most microgreens take 8 days to grow, but a select few take up to 25 days.

NYT Farm will try every avenue at their disposal to reach the customer to: confirm customers order, receive customer payment, and set up delivery or pick-up time once order is ready for customer.

NYT Farm shall provide the Customer with their chosen fresh microgreens. Microgreens will be packaged in individual clamshell containers per the product description.

NYT Farm allows cancellation and refund up to the time of the customers order being planted. After the order has been planted the order can be cancelled but is no longer eligible for a refund. All cancellation or refund requests must be made in writing. If an order is undeliverable or not picked-up due to conditions outside NYT Farm's control, the order is not eligible for a refund and not eligible for an exchange (i.e. customer went out of town and neglected to inform NYT Farm's employees via Text or Email prior to the cancelation dead line.)

NYT Farm Micro Subscription shall provide the Customer with their chosen fresh microgreens weekly, bi-weekly (every two weeks), or monthly depending on the option the customer has chosen in their order. Microgreens will be delivered in individual clamshell containers in the designated ounces according to the type of product listed on our sales page.

Micro Subscriptions are eligible for changes to their microgreen order. Please request changes 14 days prior to the delivery date you want the change to accrue and must be made in writing.

NYT Farm allows cancellation and refund up to the time of the customers order being planted. After the order has been planted the order can be cancelled but is no longer eligible for a refund. All cancellation or refund requests must be made in writing. If an order is undeliverable or not picked-up due to conditions outside NYT Farm's control, the order is not eligible for a refund and not eligible for an exchange (i.e. customer went out of town and neglected to inform NYT Farm's employees via Text or Email prior to the cancelation dead line.)

NYT Farm shall provide the Client with fresh microgreens. Microgreens will be delivered in individual clamshell containers for resale to the customers of the Client, or in a bulk container for use in recipes sold over the counter.

NYT Farm shall be excused from any delay or failure in performance required hereunder if caused by reason of any occurrence or contingency beyond its reasonable control, including, but not limited to, acts of God, acts of war, fire, insurrection, strikes, lockouts or other serious labor disputes, riots, earthquakes, floods, explosions or other acts of nature like crop failures.

The Client acknowledges and agrees that NYT Farm will not be liable for any losses or damages, to product while in the possession of the Client, whether indirect, incidental, special, or consequential, in profits, goods or services, irrespective of whether the Client has been advised or otherwise might have anticipated the possibility of such loss or damage.

The client acknowledges and agrees that NYT Farm cannot guarantee the results or effectiveness of any of the services rendered or to be rendered. Rather, services shall be executed in a professional manner and in accordance with good industry practice. Best efforts will be used but no results are promised.

We employ the use of cookies. By accessing NYT Farm, you agreed to use cookies in agreement with the NYT Farm's Privacy Policy.

Most interactive websites use cookies to let us retrieve the user's details for each visit. Cookies are used by our website to enable the functionality of certain areas to make it easier for people visiting our website. Some of our affiliate/advertising partners may also use cookies.

Unless otherwise stated, NYT Farm and/or its licensors own the intellectual property rights for all material on NYT Farm. All intellectual property rights are reserved. You may access this from NYT Farm for your own personal use subjected to restrictions set in these terms and conditions.

NYT Farm does not filter, edit, publish or review Comments prior to their presence on the website. Comments do not reflect the views and opinions of NYT Farm,its agents and/or affiliates.
